Terms of Service

1. Acceptance of Terms
By installing, accessing, or using Copper Sun Brass ("Service", "Software", "BrassCoders"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Copper Sun Brass is provided by Copper Sun Content and Creative, LLC ("Company", "we", "us", "our").
2. Description of Service
Copper Sun Brass is a development intelligence tool with two components:
- OSS Core (CLI): Open-source command-line scanner, licensed under Apache 2.0. Free for personal and commercial use, with no usage caps. Distributed via PyPI as
brasscoders. - Paid Plan (optional): A hosted enrichment gateway that adds AI-powered semantic deduplication, cluster sizing, and rank-by-relevance against your project signature. Subscription-only; activated per machine with a license key.
The OSS core operates entirely on your local machine and makes no outbound network calls by default. The Paid Plan adds an enrichment step that sends scanner findings and project signature to our hosted gateway; raw source code is never transmitted.
3. License and Usage Rights
3.1 OSS Core License
The OSS core is licensed under the Apache License 2.0. You retain all rights and obligations granted by that license; these Terms do not modify it.
3.2 Paid Plan License Grant
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the Paid Plan enrichment service.
3.3 Plan Structure
- BrassCoders Paid: $12 USD per month, billed monthly. Includes the AI-powered enrichment pipeline and 50 million enrichment tokens per month.
- Machine activations: Each license key allows up to 3 machine activations (e.g. laptop, desktop, CI runner). Run
brasscoders deactivateto free a slot on a retired machine. - Top-ups: Additional enrichment tokens can be purchased ad-hoc at
coppersun.dev/topup. Top-up tokens persist across billing periods and do not expire at month end.
3.4 License Restrictions
You may not:
- Distribute, sublicense, rent, lease, or lend the Software
- Reverse engineer, decompile, or disassemble the Software
- Remove or alter proprietary notices
- Use the Service without a valid license
- Share license keys or accounts
4. Subscription and Billing
4.1 Subscription Plans
Copper Sun Brass is offered as a subscription service with monthly billing cycles.
4.2 Payment Processing
Payments are processed through LemonSqueezy, our third-party payment processor. By subscribing, you agree to LemonSqueezy's terms of service.
4.3 Billing Terms
- Subscriptions automatically renew monthly unless cancelled.
- Payment is due in advance for each billing period.
- Price changes require 30 days advance notice to active subscribers.
4.4 Refunds
After Subscription. We do not offer refunds for partial billing periods. If you cancel your subscription, you retain access until the end of your current billing period, but no refund will be issued for the remaining days.
Billing Errors. If you are charged in error (duplicate charges, charges after cancellation, or incorrect amounts), contact us at brass@coppersuncreative.com and we will correct the error and issue a refund if applicable.
Service Issues. If you experience significant service issues that prevent you from using BrassCoders, contact us and we will evaluate refund requests on a case-by-case basis.
4.5 Cancellation
You may cancel your subscription at any time through the LemonSqueezy hosted billing portal, reachable from the CLI by running brasscoders portal. Service continues until the end of your current billing period.
5. Account Management
5.1 License Activation
You are responsible for:
- Protecting your license key
- Using the Service only on authorized devices
- Promptly reporting any unauthorized use
5.2 Downstream AI Assistants
BrassCoders produces YAML output (in .brass/ai_instructions.yaml and related files) designed to be consumed by AI coding assistants such as Claude Code, Cursor, or Continue. The Service does not require, integrate with, or proxy any third-party AI API. Any costs, API keys, terms of service, or usage limits associated with your downstream AI assistant are entirely separate from BrassCoders and remain your responsibility.
6. Data and Privacy
6.1 Local Data Storage
Copper Sun Brass primarily stores data locally on your machine in:
~/.brass/directory (global configuration).brass/directories in your projects (project-specific data)
6.2 What Leaves Your Machine
OSS-core scans make zero outbound network calls by default. With an active Paid Plan license, the Service may transmit:
- To our hosted gateway (Paid Plan only): scanner findings (already-redacted; sensitive matches like secrets and PII are masked at the scanner before they leave the machine) and a short project signature derived from your README, manifest, entrypoint, and top-level filenames. Raw source code is never transmitted.
- To LemonSqueezy: license key activation, validation, and deactivation calls. Customer email is the only personally identifying field transmitted.
6.3 Privacy Commitment
We do not:
- Collect analytics or telemetry data by default. Telemetry, if enabled explicitly via
brasscoders telemetry on, transmits only anonymized event counts. - Store your source code on our servers.
- Share your data with third parties beyond those disclosed in Section 6.2.
- Track your usage or behavior outside of license validation and quota accounting.

7. User Responsibilities
7.1 Lawful Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
7.2 Code Analysis
You are responsible for:
- Ensuring you have rights to analyze code with the Service
- Reviewing and validating all AI-generated recommendations
- Making your own decisions about code changes and implementations
7.3 Security
You must:
- Protect your license keys and API keys
- Use the Service in secure environments
- Report security vulnerabilities responsibly
8. Service Availability
8.1 Uptime
We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.
8.2 Support
We provide:
- Online documentation at coppersun.dev.
- Email support for Paid Plan subscribers via brass@coppersuncreative.com.
Support is provided during business hours (Monday-Friday, 9 AM - 5 PM Pacific Time).
8.3 Updates
We may update the Software to add features, fix bugs, or improve performance. Updates are provided at no additional cost to active subscribers.
9. Intellectual Property
9.1 Our Rights
Copper Sun Brass, including all intellectual property rights, is owned by Copper Sun Content and Creative, LLC. These Terms do not grant you any ownership rights in the Service.
9.2 Your Rights
You retain all rights to your code and project data. We claim no ownership over your content.
9.3 AI-Generated Content
Recommendations and analysis generated by the Service are provided for your use, but we make no warranties about their accuracy or suitability.
10. Disclaimers and Limitations
10.1 Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 AI Limitations
AI-generated recommendations are suggestions only. You are responsible for:
- Reviewing all recommendations before implementation
- Testing code changes in appropriate environments
- Ensuring recommendations meet your specific requirements
10.3 Third-Party Services
We are not responsible for the availability, accuracy, or performance of third-party services (including LemonSqueezy for billing and any downstream AI assistant you choose to use with BrassCoders output).
11. Limitation of Liability
IN NO EVENT SHALL COPPER SUN CONTENT AND CREATIVE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Copper Sun Content and Creative, LLC from any claims, damages, or expenses arising from your material breach of these Terms, willful misconduct, or violation of applicable laws in your use of the Service.
13. Termination
13.1 Termination by You
You may terminate your subscription at any time by cancelling through your account or contacting support.
13.2 Termination by Us
We may terminate your access to the Service for:
- Material violation of these Terms (with 7 days notice except for severe violations)
- Non-payment of fees (after 30 days past due)
- Illegal use of the Service as determined by applicable law
- Activities that pose security risks to other users or our systems
13.3 Effect of Termination
Upon termination:
- Your license to use the Service ends immediately
- You may continue to access locally stored data
- We are not obligated to maintain or return your data
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law and Export Controls
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Export Controls: The Service and Software may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export laws and not to export, re-export, or transfer the Software to any prohibited country, entity, or person without proper authorization.
